Host Tonic Terms of Service

Welcome to Host Tonic! By using our services—including web hosting, WordPress hosting, VPS hosting, dedicated servers, domain registration, and related offerings ("Services")—you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our Services.
1. Acceptance of Terms
By accessing or using Host Tonic’s Services, you acknowledge that you have read, understood, and agree to these Terms, including all referenced policies.
2. Services Provided
Host Tonic provides various hosting services including shared web hosting (cPanel-based), WordPress hosting, VPS hosting (unmanaged by default), dedicated servers, domain registration (via NameSilo, Namecheap, Spaceship, and Z.com), and professional/managed services. We reserve the right to modify or discontinue any part of the Services at any time without notice.
3. Account Registration and Eligibility

You must provide accurate, current, and complete account information.

You are responsible for all activity under your account and maintaining account credential confidentiality.

No age restriction is imposed; however, customers must comply with local laws applicable to contract formation.

We reserve the right to request KYC verification during unusual or suspicious activity.
4. Billing, Payment, and Renewal

Billing cycles: monthly for VPS, dedicated servers, and hosting; yearly billing available for all services.

Domains are billed yearly only.

Auto-renewal occurs only if sufficient funds or credit exist in your account at the renewal time.

Nonpayment suspension occurs after 7 days past due.
-
A late fee of 10% applies to overdue invoices.

Payment is required in advance; partial payments are not accepted.

Customers are responsible for all applicable taxes.
5. Refund and Cancellation Policy

Domains: Non-refundable. Refund requests within 24 hours of order completion may be reviewed but cannot be guaranteed due to registrar and registry policies.

Web Hosting & WordPress Hosting: Pro-rata refunds available for unused service periods upon cancellation, excluding setup fees and third-party add-ons or licenses. Example: If 10 months are purchased and cancelled after 5.5 months, a refund for the remaining 4 months may be issued.

VPS: No refunds, including licenses and add-ons.

Professional Services: No refunds once scheduled or work has commenced.

Refund requests must be submitted via ticket from the client dashboard; processing time is typically 5-10 business days.
6. Use of Services and User Responsibilities

Use Services only for lawful purposes.

Do not engage in any activity that harms Host Tonic’s infrastructure or other customers, such as overloading servers, malware distribution, or denial-of-service attacks.

You are solely responsible for all content uploaded, stored, or transmitted.

Crypto mining, TOR usage, and VPN/proxy use are prohibited on shared and WordPress hosting without prior approval. VPN/proxy use on VPS requires notification and approval.

Adult content is not allowed.

Null, pirated, or otherwise unauthorized themes, plugins, or software are strictly prohibited.

Customers must comply with anti-spam policies and use proper email authentication (SPF, DKIM, DMARC).

Resource-intensive software must use custom packages or VPS hosting.
7. Resource and Fair Usage Policy

CPU, RAM, and IO resources on shared/WordPress hosting are limited; short spikes (5-10 minutes) may be tolerated, but sustained excess usage may lead to service throttling or suspension.

Bandwidth, disk space, email sending limits are package-dependent; excess usage may incur extra charges or require plan upgrades.
-
VPS customers should select plans suited for their resource needs.
8. Backups and Data

Host Tonic provides best-effort backups for web and WordPress hosting with retention as follows: 6 daily, 4 weekly, and 4 monthly backups.

Backups activate 3-5 days after service commencement.
-
Restores must be requested by submitting a support ticket via the client dashboard.

Backup services are complimentary with hosting but heavy storage usage may be billable.
-
Data recovery is not guaranteed; customers must maintain independent backups.
-
VPS backups are not included unless purchased separately.
9. Service Level Agreement (SLA)
-
Host Tonic targets 95% monthly uptime for shared hosting, WordPress hosting, and VPS infrastructure.
-
If uptime drops below 95%, a 5% credit on the monthly fee may be granted; uptime below 90% qualifies for a 10% credit.
-
Credits apply only to future invoices and are not cash refunds.
-
To receive credits, customers must submit a billing ticket within 7 days after the affected month.
-
Uptime measurement excludes scheduled maintenance, customer-caused issues, DDoS attacks, force majeure, and third-party network outages.

Maintenance and incidents are published at status.tonicnode.com.
10. Data Retention and Termination

Web hosting data is retained for 7 days post-termination before deletion.
-
VPS data is deleted immediately upon termination; customers must back up data beforehand.
-
Host Tonic may suspend or terminate accounts for violations, nonpayment, or abuse.
11. Security
-
Host Tonic maintains commercial security standards for network and infrastructure.
-
Customers are responsible for securing their applications, credentials, and content.
-
Use of null/pirated software is prohibited and grounds for suspension.
-
Malicious activity including malware distribution, phishing, DDoS attack participation results in immediate suspension.
12. Domain Services
-
Domains are registered via NameSilo, Namecheap, Spaceship, and Z.com, subject to registrar and registry policies.
-
Refunds for domain transactions are generally not granted; requests within 24 hours may be reviewed but not guaranteed.
-
Redemption and restore fees may apply on expired domains according to TLD policies.
-
WHOIS data accuracy is mandatory; privacy protection available when supported.
13. Abuse and Compliance

Customers must respond to abuse reports within 24 hours.
-
Immediate suspension for malicious code, phishing, DDoS involvement, or policy breaches.
-
VPS VPN/proxy use requires prior notification and approval.
-
Spam or unsolicited bulk email practices are prohibited.
14. Limitation of Liability

To the extent permitted by law, Host Tonic’s aggregate liability is limited to fees paid in the 3 months prior to the claim.

Host Tonic is not liable for indirect, incidental, consequential damages including lost profits or data.
15. Indemnification
You agree to indemnify and hold harmless Host Tonic against claims arising from your content, use of Services, or violation of these Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of Bangladesh. We respect applicable local laws elsewhere and expect compliance by customers. Disputes are subject to the courts of Bangladesh.
17. Changes to Terms
Host Tonic may update these Terms at any time by posting updates on its website. Continued use after changes constitutes acceptance.
